Terms and Conditions of Purchase and Entry

Please read these Terms and Conditions carefully before purchasing a ticket. By purchasing a ticket you agree to be bound by these Terms and Conditions. NightQuarter is organised and run by Food Focus Australia Pty Ltd ACN 146 747 686 Pty Ltd (“We, Us, Our”). By purchasing a ticket or entering into the Premises You agree that:-

  1. These Terms and Conditions are to be read together with all other statements or directives either shown on any tickets or displayed on Our website or at the Premises.
  2. The term “including” when used in these Terms and Conditions is not a term of limitation.
  3. We reserve the right to vary these Terms and Conditions at any time by updating them. Any variations will only apply to ticket purchases made after any such variation.
  4. We reserve the right to add, withdraw, reschedule or substitute artists and/or vary advertised programs, prices, venues, seating arrangements (including ticket categories) and audience capacity.
  5. No food or drink may be brought onto the premises including alcohol or drugs of any type (unless medically required).
  6. Smoking is permitted in designated areas only.
  7. No glassware or other sharp objects may be bought on to the premises.
  8. No animals may be brought onto the premises.
  9. You may be denied entry into, or removed from, the Premises if:
    1. You breach the Terms and Conditions;
    2. You are intoxicated, under the influence of illicit drugs, inappropriately attired or adversely affecting the enjoyment of the event by others
  1. If you arrive late, you may not be admitted until a suitable break in the event.
  2. You may not be permitted to take into the event, or use, cameras or other photographic or recording equipment (including mobile phones).
  3. You may be required to submit to a search of your person and/or possessions before entering the event.
  4. Entry to an event may be refused if the authenticity or validity of a ticket is in Our opinion questionable, including because the ticket has been damaged or defaced in any way, or has not been purchased from NightQuarter or other authorised points of sale.
  5. You must allow adequate time for collection or delivery of tickets. Methods of collection and/or delivery will be available when choosing your collection/delivery details. In the interests of minimising ticket scalping, We may change your delivery method to “venue collect” at Our discretion.
  6. Where concessions are applicable, suitable and valid identification must be provided for collection of tickets and at the event.
  7. Tickets may not, without Our prior written consent, be resold or offered for resale at a premium (including via on-line auction or other unauthorised resale sites) or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services. If a ticket is sold or used in breach of this condition, the ticket may be cancelled without a refund and the ticketholder may be refused admission. We will take all reasonable steps to notify You of Our intention to cancel the ticket or render it invalid within a reasonable time before cancelling it or rendering it invalid.
  8. When purchasing tickets for a particular event You may be limited to a specified number of tickets. If You exceed the stated ticket limit, You may have any or all of your orders and tickets cancelled without notice by Us at our discretion. This includes orders associated with the same name, e-mail address, billing address, credit card number or other information. Ticket limits apply to ensure fair access to tickets for fans, and as a measure to minimise ticket scalping.

SCALPING WARNING: The resale of tickets in certain circumstances is governed by ticket sales legislation and may attract criminal penalties.

  1. Whilst We take all reasonable care to ensure that tickets are correctly priced and only available for sale when intended, sometimes errors may occur. We may cancel an order made as a result of any such error, although in the case of a pricing error We will endeavour to contact you to give you the option of purchasing the ticket at the correct price.

  3. Vehicles are parked at your own risk. We will not be responsible for loss of, or damage to any vehicle, accessory or contents in, or on any vehicle.
  4. Minors under the age of 18 must not enter licensed areas, including The Paddock without being accompanied and supervised by a parent or legal guardian 25 years of age or older.
  5. You are responsible for all persons under Your supervision and must ensure that any persons under Your supervision comply with these Terms and Conditions .
  6. Footwear and appropriate clothing must be worn at all times.
  7. You are responsible for your own personal property. We will not be liable for any person in respect of loss of life or personal injury to, any person, whether that loss, damage or personal injury is caused by any person’s negligence (including the negligence of Us) or otherwise.
  8. You must obey all reasonable instructions and warnings, given by Us and Our staff and contractors, without objection.
  9. There are restricted capacities at areas of the Premises. Once the maximum capacity is reached in these areas there will be no further admissions. You agree that Your purchase of a ticket does not guarantee admission to these areas.
  10. Photo ID is required if You wish to purchase alcohol in all cases.
  11. We do not offer a refund in the event of lost, stolen or damaged tickets or where the ticket holder cannot attend the event due to reasons beyond Our control.
  12. We do not replace any lost, stolen or destroyed tickets or exchange or substitute tickets after purchase, except in limited circumstances.  We reserve the right to charge you a reasonable fee for the replacement of tickets.   Please treat your tickets like cash, as we cannot replace lost tickets.
  13. We reserve the right to alter the date, the venue and the entertainment and activities as advertised, without prior notice to you.  Your entitlement to a refund in such circumstances is determined by NightQuarter.
  14.   If the date, time or venue of an event is rescheduled or changed, your ticket will remain valid for the rescheduled date, time and venue.
  15. You must apply for a refund within a reasonable time. We do not offer refunds or exchanges as a result of a change in your personal circumstances.  If we authorises a Refund, We will refund to you the ticket price.
  16. Any refund payable can only be made back to the credit card (whether temporary or otherwise) used in the original transaction.
  17. We fulfil Our commitment to you for the sale of tickets by either mailing or emailing the ticket to you, or by making the ticket available at the door to collect.
  18. If you have elected to receive the tickets by mail or email and have not received your ticket(s) within 48 hours of the event, please contact Oztix.
  19. If an event is cancelled or rescheduled Our liability is limited to the amount for which the ticket was purchased. Proof of purchase may be required for any refund or exchange. We will not be liable for any other losses incurred by You as a result of the cancellation, rescheduling or relocation of an event, including any travel and accommodation expenses.
  20. We do not replace lost, stolen, damaged or destroyed tickets if the authenticity of the ticket cannot be verified, including proof of purchase, and only if You give reasonable notice before the event. We may charge a reasonable fee for the replacement of tickets. We are not required to replace tickets where seating is unallocated (general admission tickets).
  21. Minors must be accompanied by a legal guardian over the age of 25 years.
  22. The Website Terms of Use and the NightQuarter Australia Privacy Policy are incorporated into these Terms and Conditions and apply to all sales through this Site.
